Two cases begin the night of the arrest.

A California DUI usually moves on two separate tracks at once: an administrative case with the DMV over your license, and a criminal case in court. Each has its own rules and its own deadlines.

10days

The DMV hearing

In most cases you have only 10 days from the date of your arrest to request an Administrative Per Se (APS) hearing with the DMV. If no hearing is requested, a license suspension typically takes effect automatically once the temporary license period ends.

At the hearing, the DMV must prove its case on several specific issues, including whether the officer had reasonable cause and whether the arrest was lawful. Kellee has represented well over a thousand clients at APS hearings.

  1. Arraignment

Your first appearance. Your attorney typically enters a not-guilty plea and sets a pretrial date.

  2. Pretrial

The evidence is reviewed, possible motions are evaluated and negotiations with the prosecutor begin.

  3. Resolution

You decide, with counsel, whether to accept an offered disposition or take the case to jury trial.

The criminal court case

California Vehicle Code 23152 defines DUI in several ways, from impairment by alcohol or drugs to driving with a blood alcohol concentration of 0.08% or higher. A conviction can bring fines, probation, education programs, license consequences and, in some cases, jail.

Planning ahead, at a calmer pace.

Estate planning is about the people you want to look after and the decisions you would rather make now than leave to chance. A consultation is a chance to talk through your family's situation, understand how wills and trusts work, and decide what makes sense for you.

Know the law. Know your rights.

Plain-language answers to the questions Kellee hears most from people facing a DUI for the first time.

Cannabis & impairment

Can You Get a DUI for Weed in California?

California Vehicle Code 23152(f) makes it illegal to drive under the influence of any drug, including legally purchased cannabis. Unlike alcohol, there is no legal THC limit.

Professional licenses

Will a DUI Cost You Your Professional License?

A single misdemeanor DUI rarely ends a nursing, teaching, or real estate career in California, but you will usually have to report it to your licensing board.
